Our client had built a small extension to the rear of his shop, at first floor level.
Richmond Upon Thames Council requested that a planning application be submitted to regularise the breach, but then issued a refusal.
The client faced the prospect of planning enforcement action, with the risk that he might have to demolish the structure.
Although the site is located in a conservation area, the council was not concerned about harm to the character and appearance of the area.
It was, however, worried about harm to neighbours on either side.
Although the council considered that the proposal conflicted with its planning guidance in the House Extensions and External Alterations Supplementary Planning Document 2015, we persuaded the appeal inspector that the extension was sufficiently shallow in depth that the neighbours would not suffer an undue loss of light or outlook.
If you have been refused planning permission for an extension in Richmond, please do not hesitate to contact our planners for advice on your prospects of success at appeal.
