Local planning authorities have an unfortunate habit of removing a homeowner’s permitted development rights when they grant permission for houses and sometimes even when they are just approving run-of-the-mill extensions.

We are written before (see here) on why it is not usually considered reasonable for a council to use a planning condition to remove a homeowner’s permitted development rights.

Such conditions are only rarely justified, must be limited and targeted and must be site-specific.

In this case, we helped our client get his permitted development rights reinstated. We were delighted when our application to Kingston upon Thames Council was approved first time round!
