This appeal related to a refusal of planning permission for a loft conversion with side and rear dormer extensions at a semi-detached property in Redbridge.

The council refused the application on the grounds that the scale and prominence of the proposed side dormers would harm the character and appearance of the host dwelling and the street scene, and that the proposal conflicted with the council’s design guidance for roof extensions.

At appeal, the inspector accepted that the side dormers would be clearly visible in the street scene and would alter the appearance of the dwelling. However, the inspector placed weight on the detailed design of the proposal, noting that the dormers would be set back from the front gable, set up from the eaves and would not project above the main ridge, such that the key architectural features of the host building would be preserved.

Crucially, the inspector also identified a number of large dormer extensions already visible within Leyswood Drive, including examples on nearby corner properties and dwellings with a similar orientation to the appeal site. The inspector found that this type of development had become characteristic of the street, and that the proposed dormers, although substantial, would have a similar effect on the host dwelling and the street scene as those existing examples.

While the proposal did not comply with all elements of the council’s Housing Design Supplementary Planning Document, the inspector concluded that material considerations justified a departure from that guidance. In particular, the presence of similar dormer extensions in the street, some of which appeared to have been carried out as permitted development, was found to be a significant factor.

The inspector therefore concluded that the proposed loft conversion with side and rear dormers would not have a materially detrimental effect on the character and appearance of the host dwelling or the street scene, and that the development complied with the relevant policies of the Redbridge Local Plan. The appeal was allowed and planning permission was granted, subject to conditions.
